Bawadi for Peace and Development Organization is following with deep concern the discussions regarding initiatives for the voluntary return of Sudanese refugees from Uganda to Sudan under the current circumstances. We affirm that raising the issue of return at this time is misleading for the refugees, as the reasons that forced them to seek refuge have not yet been addressed; rather, they have worsened with the absence of security, the spread of diseases, recurring incidents of extrajudicial killings, and the issuance of unjust rulings against some community groups under pretexts such as the “Law of Strange Faces” or accusations of collaboration, and the like.
According to the legal standards of the United Nations High Commissioner for Refugees (UNHCR), return is conditional upon several legal foundations, most notably:
- That the return be entirely voluntary, without any pressure or deception.
- That it takes place in conditions of safety and dignity, with guarantees that returnees will not be subjected to persecution or discrimination.
- That it occurs under a comprehensive and sustainable peace, with the root causes of displacement, such as conflict or persecution, removed.
- That essential services and livelihood opportunities are available to ensure the stability of returnees.
- Refugees must receive accurate and reliable information about the situation in their countries of origin.
- Refugees must take part in the planning process for return.
- Voluntary return must include support for refugees to ensure their reintegration into their original communities.
- There must be effective mechanisms in place to monitor the voluntary return process.
Without meeting these conditions, no entity genuinely concerned with human rights can adopt such calls. If these initiatives are being managed by the Port Sudan authorities through their embassy in Kampala, we seriously question the fate of refugees from Darfur and Kordofan—areas under the control of the Establishment Government. Does the initiative include them, or is it intended to be used politically to divide refugees along ethnic, political, or geographical lines? We categorically reject any return based on discrimination or the manipulation of refugees’ destinies and dignity.
Accordingly, we call on the Sudanese civil society in Uganda to confront these misleading calls, to intensify awareness about the dangers of return under the current circumstances, and to emphasize that the priority is the protection of refugees and supporting their resilience until the conditions for safe and dignified return are achieved.

بيان حول مبادرة العودة الطوعية للاجئين السودانيين من أوغندا إلى السودان
إنّ منظمة بوادي للسلام والتنمية تتابع بقلق بالغ ما يُتداول بشأن مبادرات العودة الطوعية للاجئين السودانيين من أوغندا إلى السودان في ظل الأوضاع الراهنة. ونؤكد أنّ طرح العودة في هذا التوقيت يُعد تضليلاً للاجئين، إذ إن الأسباب التي دفعتهم إلى اللجوء لم تُعالج بعد، بل تفاقمت مع غياب الأمن، وانتشار الأمراض، وتكرار حوادث القتل خارج إطار القانون، وصدور أحكام غير عادلة بحق بعض المكونات المجتمعية تحت ذرائع مثل “قانون الوجوه الغريبة” أو اتهامات بالتعاون ما الى ذلك.
كما ان العودة حسب المعايير القانونية للمفوضية السامية للأمم المتحدة لشؤون اللاجئين (UNHCR) مشروطة بعدة أسس قانونية أبرزها :
- أن تكون العودة طوعية بالكامل دون أي ضغط أو تضليل.
- أن تتم في ظروف أمان وكرامة، مع ضمان عدم تعرض العائدين للاضطهاد أو التمييز.
- أن تتحقق في ظل سلام شامل ومستدام، مع زوال أسباب اللجوء من نزاع أو اضطهاد.
- أن تتوفر خدمات أساسية وفرص معيشية تكفل استقرار العائدين.
- يجب أن يحصل اللاجئون على معلومات دقيقة وموثوقة حول الوضع في بلدانهم الأصلية.
- يجب أن يشارك اللاجئون في عملية التخطيط للعودة.
- ضمان إعادة إدماج اللاجئين في مجتمعاتهم الأصل.
- يجب أن تكون هناك آليات فعالة لمراقبة عملية العودة الطوعية لضمان احترام حقوق اللاجئين وسلامتهم.
عدا ذلك لا يمكن لأي جهة حريصة على حقوق الإنسان أن تتبنى مثل هذه الدعوات إلا عند توفر الشروط المشار إليها. وإذا كانت هذه المبادرات تُدار من قبل سلطة بورتسودان عبر سفارتها في كمبالا، فإننا نتساءل بجدية عن مصير اللاجئين المنحدرين من مناطق دارفور وكردفان الواقعة تحت سيطرة حكومة التأسيس، هل تشملهم المبادرة أم يُراد توظيفها سياسياً لتقسيم اللاجئين على أسس إثنية أو سياسية أو جغرافية؟ إننا نرفض رفضاً قاطعاً أي عودة تقوم على التمييز أو التلاعب بمصائر اللاجئين وكرامتهم.
وبناءً على ذلك، ندعو المجتمع المدني السوداني في أوغندا إلى التصدي لهذه الدعوات المضللة وتكثيف التوعية بخطورة العودة في الظروف الحالية مع التأكيد على أن الأولوية هي حماية اللاجئين ودعم صمودهم إلى حين توفر شروط العودة الآمنة والكريمة.
